Carlyle R. Wimbish, III - Principal
 

Randy Wimbish is Chair of the firm's Healthcare practice group. He concentrates his practice primarily in the area of medical professional liability in both state and federal courts throughout Virginia. Randy has represented physicians in a wide variety of medical specialties, as well as dentists, nurses, allied health providers, and hospitals of all types and sizes. He has tried more than fifty jury cases, and has presented numerous other cases to medical malpractice review panels and to arbitrators in lieu of a jury trial. He has extensive experience with mediation and other forms of alternative dispute resolution.

Randy's practice includes advising health care providers on risk management in order to prevent claims before they occur. He also represents health care providers before various state regulatory and disciplinary boards.Randy has significant appellate experience, as well. He teamed with Margaret Hardy to win the landmark case of Sanchez v. Medicorp, 270 Va. 299 (2005), which significantly limits liability for Virginia’s hospitals for the alleged negligence of non-employee physicians.

Randy has lectured frequently to both health care providers and attorneys on subjects related to medical negligence cases, and is a contributing author to Medical Malpractice Law in Virginia and the Virginia Medical Law Report. He has been listed by Virginia Business magazine as one of Virginia’s “Legal Elite” and in the 2006 and 2007 Virginia Super Lawyers.

Randy has a strong track record of successful representation of health care providers at trial. Since 2000, his trial record is 24-1 in his clients’ favor. He is particularly proficient in the defense of high risk, high exposure cases, including cases involving a high degree of sympathy that can tilt the scales in favor of the plaintiff at the beginning of the case. Over the years, Randy has obtained defense verdicts for doctors and hospitals in cases involving maternal death, child and infant death, neurologically compromised infants (so called “bad baby” cases), and a brain stem stroke resulting in a "locked in" state and over $3 million in medical expenses. He has been recognized by Virginia Lawyers Weekly and the Virginia Medical Law Report for obtaining two of the largest defense verdicts in Virginia in 2004, five of the largest defense verdicts in Virginia in 2005, two of the largest defense verdicts in Virginia in 2006 and three of the largest defense verdicts in 2007.

As a graduate of Virginia Tech, Randy is an avid follower of the Hokies' football program. His other interests include reading and traveling with his wife and three sons. He is an active member of Derbyshire Baptist Church, serving  as Deacon, and has been involved in a variety of other civic activities.
