Immigration Update: Simple Compliance Steps Avoid Employer Fines

National immigration policy remains unresolved. To date, much of the immigration law compliance responsibilities have been passed on to employers. Employers who do not comply can be fined up to $5000 for each violation.
There are simple steps that an employer can take to be in compliance. This program will provide an overview of the important visa categories and will also outline specific responsibilities of an employer. The topics to be covered include:
- Avoiding national origin/citizenship discrimination in recruiting and selecting an employee (when and how to ask about an applicant's immigration status)
- Understanding the U.S. immigration framework (temporary work permits, special employment visas, unskilled workers, and permanent residency)
- Social Security "no-match" requirements and other liability issues for employers
- Record keeping requirements
Ms. Katz has been recognized by her peers for the last five years in Virginia Business magazine's Legal Elite for her employment practice and commitment to pro bono service. She has been an employment attorney for over 25 years, including serving three Governors as head of Employee Relations. She teaches Human Resource Management at VA Tech.
Mr. Kuhn represents U. S. companies with operations and projects domestically and internationally, as well as European and Asian companies with operations and interests in the U.S. His law practice focuses on international trade, business issues and immigration. He has practiced law in Germany. He is chair of the German American Business Association of Richmond and serves on the Board of Governors of the International Practice Section of the Virginia State Bar.
