The team consists of the past chair of the Board of Governors for the Bankruptcy Section of the Virginia State Bar, the current and past chairs of the Bankruptcy Section of the Richmond Bar Association, a Chapter 7 bankruptcy panel trustee, a Certified Public Accountant, and a former bankruptcy judicial law clerk. Workouts and Restructuring
Whether in or out of court, the Bankruptcy Team handles numerous cases involving debt restructuring and reorganization, and thoughtfully counsels clients facing financial distress on the range of available options. Our preference is to resolve matters without resorting to bankruptcy or litigation, but that is not always possible.
We have experience filing Chapter 11 debtor cases for businesses, such as manufacturers, distributors, landlords, real estate developers, contractors, service providers, and business owners. A substantial majority of these cases have resulted in confirmed plans.
Our individual clients tend to have complex financial or legal situations that require a higher level of service than a typical bankruptcy case. We have represented those individuals with filings under Chapters 11 and 7 of the Bankruptcy Code.
The Bankruptcy Team represents debtors, creditors, and trustees, in the bankruptcy claims process, contested matters, adversary proceedings, and through all stages of appeal. Our experience in bringing these actions gives us special insight on how to defend against them. We have extensive experience in assisting our clients with filing and defending bankruptcy claims, landlord-tenant disputes, lien determinations, and defending against allegations of fraudulent conveyances and preferential transfers.
Creditor and Official Bankruptcy Committee Representation
We frequently represent creditors in various collection matters. We understand the strategies used by parties during loan workouts and bankruptcy, which enables us to maximize recovery for our clients.
We serve as counsel to numerous creditors' and ad hoc committees. Additionally, we have served as counsel to committee members, including the chairs of those committees.
Trustees and Receiverships
We routinely represent Chapter 7 Trustees in collecting and selling assets that are property of the bankruptcy estate.
We also serve as court-appointed trustee or receiver or trustee. At the request of the Securities and Exchange Commission (SEC), one attorney on our team is the court-appointed Receiver in two large Ponzi cases. As receiver, we seek to recover assets and return them to defrauded investors.
