Workers' Compensation
Sands Anderson Marks & Miller has proudly defended employers, insurers and self-insureds throughout Virginia in workers' compensation matters for the past half century. We handle all phases of workers' compensation litigation, including hearings, dispute resolution and appeals before the Virginia Workers' Compensation Commission as well as, through its Appellate Practice group, appeals to the Virginia Court of Appeals and Supreme Court of Virginia.
Experience
The firm has one of the largest workers' compensation defense practices in Virginia with 12 attorneys and nine paralegals. Our attorneys bring wide-ranging experience to the practice including pre-law careers in sports medicine and transportation as well as legal experience at the Virginia Workers' Compensation Commission. One of our team's senior attorneys is listed in the current edition of The Best Lawyers in America in the area of workers' compensation. Sands Anderson's attorneys are active in the Workers' Compensation Section of the Virginia Association of Defense Attorneys, as well as the Defense Research Institute.

Setting Precedents
In recent years, Sands Anderson lawyers have tried and won cases, which have favorably shaped the landscape of Virginia workers' compensation law for employers. Published cases from the Supreme Court and Court of Appeals include The Stenrich Group v. Jemmott, which eliminated cumulative trauma as an occupational disease, and Allied Fibers v. Rhodes, which similarly eliminated hearing loss. We thwarted an effort to require reimbursement by the workers' compensation carrier of a health insurance carrier's payments, Bogle Development Co. v. Buie. We represented the Virginia Association of Counties in filing a "friend of the court" brief in the Supreme Court of Virginia in Overbey v. Augusta County Sheriff's Department, a case in which the Court reinvigorated the defense of heart and respiratory disease claims against public employers.
