Ashley Burgess serves as the leader of the firm's Business group. He concentrates his practice on business formation and transactions, as well as business litigation, representing individuals and businesses before judges and juries in state and federal courts across the Commonwealth.   

Ashley's experience includes business entity formation, acquisitions, shareholder disputes, creditor's rights and commercial collections, protection of creditor claims in bankruptcy, lien enforcement, consumer protection and fraud claims, landlord tenant cases, estate disputes, real estate contests, breach of contract actions, and complex torts. 

His recent accomplishments include:

  • Representing creditors of LandAmerica through adversary proceedings in the Chapter 11 bankruptcy case pending in the Eastern District of Virginia, Richmond Division;
  • Defending a corporation from a shareholders derivative suit;
  • Representing a regional motor vehicle dealer in the acquisition of multiple dealerships;
  • An award of judgment in favor of the Plaintiff at trial for all damages requested in a property damage action in the Circuit Court of Henrico County;
  • A defense verdict in a federal jury trial involving alleged civil rights violations;
  • A judgment following a one day bench trial in a hotly contested commercial collections matter, successfully defending the judgment on appeal to the Supreme Court of Virginia and obtaining full satisfaction of the judgment upon enforcement;
  • Summary judgment and judgment in favor of the defendant in two separate cases involving self-service storage facilities accused of negligence and breach of contract;

Ashley has conducted lectures and presentations before trade groups and in-house seminars for corporate clients on such topics as the anatomy of a civil lawsuit, insurance law and commercial collections.

Ashley worked as a law clerk with Sands Anderson during the Summer of 2003 and joined the firm directly from law school.  His experience also includes a clerkship with the Pennsylvania Governor's Office of General Counsel, as well as serving as an intern under The Honorable Gary A. Hicks of the Circuit Court for the County of Henrico, Virginia.

Ashley graduated from the George Mason University School of Law, where he was Research Editor of the George Mason Civil Rights Law Journal. He is a 1999 graduate of James Madison University, earning his B.S., magna cum laude.  Ashley hails from Northumberland County in the Northern Neck of Virginia. Ashley was listed in Super Lawyers®, 2010 and 2013 edition as a Rising Star in Business/Corporate and the 2014 and 2015 editions as Rising Star in Bankruptcy & Creditor/Debtor Rights. He was also listed among Virginia Business magazine's Legal Elite 2015 for Bankruptcy/Creditors' Rights.
